Gerosa was apprehended by authorities in Italy on the basis of an Interpol notice activated by the ED in connection with its money laundering probe in the Rs 3,600 crore AgustaWestland VVIP choppers deal case. Carlo Gerosa along with Guido Haschke and Christian Michel were three crucial middlemen in the VVIP chopper deal.

According to the Carlo Gerosa release order, extradition can only be allowed where expressly provided for by international conventions. The document states that absence of treaty cannot be remedied by interpretation of even in case a legal basis was identified. It adds coercive measures cannot be applied 'if there are reasons to believe that the conditions for a judgement in favour of the extradition do not exist.' Thus, as a result, Gerosa will be released unless being detained for other reasons.
