  • He spoke about the charges of the Chief Justice of India being targeted through a conspiracy of sexual harassment allegations against him

Senior Supreme Court lawyer Harish Salve on Friday spoke to Republic Media Network's Editor-In-Chief Arnab Goswami during The Debate about the charges of the Chief Justice of India being targeted through a conspiracy of sexual harassment allegations against him.

Salve said that the matter is of grave concern as there is an "existential crisis in the highest judicial institution". He said that it was worrying to him that people are more ready to believe the lady who made the allegations than someone who is the highest judicial officer of the country and that this was the third "attack" in a row against CJIs, the first two being against former Justice Jagdish Singh Khehar and former Justice Dipak Mishra

"There is an existential crisis in the highest judicial institution. and that worries me and worries me seriously. Yes, we all accept that gender justice is an important part of the Constitution. We have to have a structure in which allegations of sexual harassment are addressed. In law, we always say however high and mighty you are, the law is above you and we all accept that and nothing I say should be considered as commenting on the merit of the allegations.

"What concerns me are the institutional problems arising at two levels. Look at where we are today. There is an allegation made by a lady, there is a strong denial made by Chief Justice of India saying this is motivated. Why are we more inclined to believe what the lady has said and less inclined to believe the highest judicial officer of the country is saying and on that basis, saying that since the lady has said so much it must be inquired into and he must be stopped from discharging duties. That worries me and it worries so much because this is third (such incident) in a row."

The Supreme Court bench on Thursday heard lawyer Utsav Bains' who claimed about a "larger conspiracy" at play to frame Chief Justice of India (CJI) Ranjan Gogoi in relation to the sexual harassment allegation levelled against him and decided to probe the sensational charge. Since then, the heat over the debate about the claims about conspiracy allegations has only increased with several speaking up on the matter.
