We have considered all provisions of the code of civil procedure. No legal impediment. I’m referring the case for mediation: CJI Ranjan Gogoi
The Ayodhya matter has been referred for mediation.
The titleholder claimants Sunni Waqf Board and Ram Janmabhoomi Nayana Samiti needs 8 weeks to check the translation of documents. My opinion is that it is a waste of time, since the lands have already been nationalised. So, neither the Waqf Board nor the other stakeholder will get the land, they will get the compensation. So only my prayer would survive which is that I have a fundamental right to pray there. The Ram Mandir being constructed is now certain, it is only a matter of time. If they consider my petition, then it (Ram Mandir) will be built before time: BJP MP Dr Subramanian Swamy
The five-judge Supreme Court bench, on Friday, is scheduled to pronounce order on whether to refer Ayodhya's Ram Janmabhoomi-Babri Masjid land dispute case for a court-monitored mediation.
The five-judge Constitution Bench headed by Chief Justice Ranjan Gogoi on Wednesday had reserved the order after hearing petitions of various contesting parties - including Nirmohi Akhara, Akhil Bharatiya Hindu Mahasabha and the Muslims bodies.
While Hindu bodies except Nirmohi Akhara had opposed the suggestion of the apex court to refer the issue for mediation, the Muslim bodies supported it.
The Top Court Five-judge bench had asked the stakeholders in the Ram Janmabhoomi – Babri Masjid title dispute case to suggest names for the mediators or panelists for mediation. Apart from CJI, Justice SA Bobde, Justice NV Ramana, Justice UU Lalit and Justice DY Chandrachud were part of the bench.
"There need not be one mediator but a panel of mediators. When the mediation is on, it should not be reported on. It may not be a gag, but no motive should be attributed to anyone when the mediation process is on," Justice Bobde had said while pronouncing the order.
The Nirmohia Akhara on Wednesday proposed the names of Supreme Court Retired Judge Kurian Joseph, AK Patnaik and GS Singhvi as the mediators in Ayodhya Title dispute case.
While Akhil Bharatiya Hindu Mahasabha has proposed three names to be Former Chief Justices Dipak Misra, Jagdish Singh Khehar and Former Supreme Court Judge AK Patnaik as the mediators.
