In a major development in the rape case against Binoy Kodiyeri, he has appeared before the Mumbai Police to record his statement on July 8, Monday. He appeared before the Mumbai Police after two unanswered summons and after being untraceable for a month.
Sources have informed Republic TV that he was given anticipatory bail on the points that he will appear before the Police to register his statement every Monday between 10 to 1. This is the first time he has reached the Oshiwara Police station since the time FIR was filed against him. He was given bail on 4 terms and condition - first that he cannot leave the country at any cost, second that he will coordinate with the Police regarding the case, third he will appear in the Police station every month to record his statement and fourth that DNA test will be conducted. Sources also added that if he fails to appear even one week, then his bail will be cancelled. However, its not clear if the Police will take the blood samples. Reports are still to arrive on it.
Binoy Kodiyeri, son of top CPI(M) Kerala leader Kodiyeri Balakrishnan has been absconding since last few days. A bar dancer, who hails from Bihar has filed a rape case against Binoy in Mumbai’s Oshiwara police station. In her complaint, the complainant has alleged that Binoy had married her and they have an 8-year-old son. In 2018, she came to know that Binoy had cheated on her and that he is already married. She has demanded a DNA test, which the latter's advocate denied. In the month of January 2019, the woman had sent a legal notice to the victim and demanded Rs 5 crore for maintenance to raise their child. But after receiving a legal notice from the woman, Binoy refuted all the claims of the woman. Binoy said he had never married her and that the 8-year-old child is also not his son.
Rejecting the allegations, Binoy told the media said that the woman blackmailed him and had asked him for Rs 5 crore about six months.
As per the complaint filed by the victim, she met Binoy in 2008 at a dance bar in Dubai where she used to work as a dance. In her complaint, she has also claimed that she has an eight-year-old son from the relationship.
Binoy, booked under Indian Penal Code sections 420 (cheating) and 376 (rape). Meanwhile, distancing himself from his son, Kodiyeri Balakrishnan said neither he nor his party will protect Binoy. He also denied allegations that his family was contacted by the 33-year-old woman on whose complaint the Mumbai police registered a case against Binoy Kodiyeri.
"Neither my party (CPI-M) nor I will protect Binoy Kodiyeri. He is an adult. He stays as a separate family and is responsible for his actions," Balakrishnan told reporters in his first statement on the matter.
