Tis Hazari clash: Delhi HC grants interim protection from coercive action to 2 Delhi cops

The Delhi High Court on Friday said that "no coercive action" should be taken against the two Delhi police officials who allegedly fired at a lawyer during the clashes at Tis Hazari court, till December 23. A division bench of Chief Justice DN Patel and Justice C Hari Shankar was hearing an application filed by the Delhi Police seeking no coercive action to be taken against Assistant Sub Inspectors Kanta Prasad and Pawan till the completion of judicial inquiry in the incident. The ASIs had been previously suspended after three FIRs were filed against them.

Representing the Delhi Police, advocate Rajdipa Behura sought limited protection and argues that the two accused should not be arrested during the pendency of the judicial inquiry in the incident. "We are two legs of this society, we should live in harmony. The second prayer is by Additional Chief Metropolitan Magistrate (ACMM) that status report should be filed, however, according to the protocol, until the judicial enquiry is concluded, no subordinate court can pass any order," Behura said. He also contended that the lawyers part of the incident had also been granted similar protection.

HC issues notice to bar associations

The High Court also issued a notice to the Delhi High Court Bar Association, Bar Council of Delhi and Bar Council of India. Based on the application, these notices were issued and the bar associations had been granted time to file their response. DHCBA president advocate Mohit Mathur opposed the application of Delhi Police while alleging that the police were not investigating the case properly. Mathur claimed the lawyers are not being provided with the FIR copy.

Tis Hazari tussle

A sudden scuffle broke out between the lawyers and the police at the Tis Hazari Court in Delhi on November 2. According to the reports, one lawyer was injured in a gunshot and was rushed to St Stephen's Hospital. As per the reports, the trigger behind the violence was a rift between the police and lawyers over parking issues in the Tis Hazari premises which turned ugly.
