In Srinagar hotel incident, Major Leetul Gogoi to face Court Martial after Court of Inquiry finds him accountable

A court-martial has been ordered against Major Leetul Gogoi following a Court of Inquiry in the Srinagar hotel incident

The Indian Army's Major Leetul Gogoi is to face court-martial in relation to an incident involving him and a local woman that had taken place in May at a hotel in Srinagar this year, following a court of inquiry that was constituted over the matter finding him accountable.

WHAT THE COURT OF INQUIRY DETERMINED

Major Leetul Gogoi, who on May 23 had been detained by the Jammu and Kashmir police after an altercation had broken out over him allegedly trying to enter the hotel in Srinagar with an 18-year-old woman, has been held accountable by the court for:

  • Fraternising with locals inspite of instructions to the contrary
  • Being away from the place of duty while in an operational area

While Major Gogoi cannot be prosecuted under civil law as the woman in question was not a minor and had not given an adverse statement against him, his actions have been determined to be in violation of the Army Act.

THE SRINAGAR HOTEL INCIDENT

At the time of the incident, Major Gogoi, along with another Army Officer, had allegedly been denied entry into the hotel on account of them being with the Kashmiri woman. The Police arrived at the location, following which the Army also took note of the incident.

At that time, the matter had also burst into the public spotlight on account of the controversy swirling around Major Gogoi mounting a local stone-pelter to his Army jeep in an effort to allow himself and his men to escape from a mob of pelters who had attacked a polling booth, without having to resort to using their guns.

THE ARMY CHIEF HAD PROMISED ACTION IF FOUND GUILTY

In the days following the hotel incident, Chief of Army Staff General Bipin Rawat promised stringent action against Major Gogoi if he was found guilty of the charges. The Army chief had said, "If any soldier of Indian Army, at any position or place, commits something wrong, and if it comes to our notice, we will take strictest of actions. If Major Gogoi has done something wrong, I can assure you that there will be punishment. And the punishment will be such that it will be an example for the times to come."
