Maharashtra Government moves to Supreme court against Gautam Navlakha's release from House arrest by Delhi High Court

The Maharashtra government on Wednesday morning moved the Supreme Court against Gautam Navlakha’s release from house arrest by the Delhi High Court. The state government was seeking to put a stay the order passed by the Delhi High court and restore the house arrest of Gautam Navlakha in the Bhima-Koregaon case.

“The state has filed the petition in the Supreme Court registry to revoke the verdict of the Delhi High court,” said Nishant Katneshwar, counsel for Maharashtra government.

Five weeks after Gautam Navlakha was arrested by the Pune police in the connection with the Bhima-Koregaon violence case, the Delhi high Court on Monday freed the activist from his house arrest. A High Court bench including Justice S Muralidhar and Vinod goel revoked Navlakha’s house arrest and squashed the transit remand order released by the Maharashtra government.

On Monday, the Delhi HC pointed out that the apex court had extended the house arrest for the five activists by four weeks so that they can avail for appropriate legal remedy, which Navlakha had used. The HC also said that 65-year-old activist’s transit remand order issued by Pune Police was unsustainable in law and regarded his arrest as “untenable”.

On Tuesday, the Pune Police said that the Maharashtra government’s counsel were studying the order released by the Delhi High Court to decide upon the legality of the judgment by the HC.

“Our government pleaders are studying the order of the high court and our investigating officer is also travelling to the national capital. So after obtaining their legal opinion, the further course of action will be decided,” said Shivaji Bodkhe, Joint Commissioner of Police (Law and Order).

He was arrested by the Pune police from the national capital along with four other accused in connection with the Bhima-Koregaon violence case from different parts of the country. Besides Gautam Navlakha, Varavara Rao, Arun Ferreira, Sudha Bharadwaj and Vernon Gonsalves were arrested in the matter and they were put to house arrest on August 29.
