The Madras High Court on Wednesday allowed Marina burial for DMK supremo M Karunanidhi, who breathed his last on Tuesday at 6.10pm.
The Tamil Nadu government argued that sitting and former chief ministers can't be treated as equals. The state also insisted that the DMK can't challenge press release by the government expressing inability to allot space at Marina beach for Karunanidhi. To this, the DMK's lawyer replied, "Anna, who is the founder of DMK, used to say my life & soul is Karunanidhi. Burying Karunanidhi next to Gandhi Mandapam cannot be termed as a decent burial."
"You (state govt) have announced state mourning, why not give land for burial? There's no prohibition under Central Govt protocol to allot land at Marina beach for ex-CMs," added DMK's lawyer.
The DMK lawyer also said, "There are 1 crore DMK followers in Tamil Nadu out of 7 crore population of the state. They'll be offended if burial land is not allotted for Karunanidhi at Marina beach."
The government stated in its counter affidavit that DMK chief Karunanidhi himself didn't allot land for former CM Janaki Ramachandran after understanding the protocol manual when Karunanidhi was the CM.
The counsel representing the Tamil Nadu government put forth that there are 3 memorials at Marina - CN Annadurai, MGR and Jayalalithaa and pointed out that all the leaders passed away while they were in office. However, in case of former Chief Ministers, if a request is made for burial, they are always alotted area at Gandhi Mandapam. Some of former CMs buried at Gandhi Mandapam are Rajaji, Kamaraj and Bhaktavatsalam.
The judge asked why this distinction between sitting and former Chief Ministers hadn't been mentioned earlier, to which the government's counsel replied that Chief Minister EPS had sought precedents and taken a decision accordingly.
The hearing turned heated at times, especially when the government's counsel called the withdrawal of petitions regarding burials at Marina beach 'stage-managed'. He was referring to the Madras High Court dismissing petitions filed by Traffic Ramaswamy, K Balu & Duraisamy, with the latter two having withdrawn their petitions on Tuesday night. The High Court, meanwhile, directed Traffic Ramaswamy’s lawyer to file memorandum that he has no objection to bury Karunanidhi’s body at Marina beach. The lawyer submitted the memorandum to the acting Chief Justice.
The High Court resumed hearing the case against denial of burial land by Tamil Nadu Government at Marina beach for M Karunanidhi after the state government filed counter-affidavit in the case.
On Tuesday, the acting Chief Justice of the Madras High Court decided to adjourn the case after the Tamil Nadu government sought additional time to file its reply to the DMK's affidavit.
Dravida Munnetra Kazhagam (DMK) supremo M Karunanidhi breathed his last at 6.10 pm on Tuesday. While issuing a press release, Chennai's Kauvery hospital announced the sad demise of "beloved Kalaignar".
Karunanidhi was admitted to Kauvery hospital on July 28, following a drop in his blood pressure. Prior to being admitted, Karunanidhi was undergoing treatment at his Gopalapuram residence for fever due to Urinary Tract Infection (UTI).
