MASSIVE: Home Ministry warns foreign funding violators, sets 1-month deadline for FRCA registered entities to apprise it of post-registration changes

In a massive decision relating to foreign funding for entities in India and the Foreign Contribution (Regulation) Act, 2010, the Home Ministry has issued a notice mandating the requirement of online submission and approval before effecting any change in the list of office bearers/key functionaries of FCRA-registered associations.

In a massive decision relating to foreign funding for entities in India and the Foreign Contribution (Regulation) Act, 2010, the Home Ministry has issued a notice mandating the requirement of online submission and approval before effecting any change in the list of office bearers/key functionaries of FCRA-registered associations.

The notice highlights that there have been violations of the above mandate earlier, wherein some of those registered under the act have changed their office bearers without permission and without updating the same via the requisite mechanisms.

Accordingly, the notice calls all these entities who have changed their office-bearers and key members after being registered under FCRA to make the required submissions and obtain approvals within one month, failing which penal action shall be initiated.

The FCRA is intended at regulating the acceptance and utilisation of foreign contributions or hospitality by entities - whether individuals, associations or companies - for activities that are detrimental to the national interest.
