Nirbhaya case: Delhi court admits parents's plea seeking transfer of case to another judge

Delhi's Patiala House Court on Saturday admitted a petition filed by parents of Nirbhaya, who was a victim of a brutal gang-rape back in 2012, seeking transfer of the case to another judge after the two judges who were hearing the case got transferred. Nirbhaya's parents had approached the court seeking the case to be fast-tracked in December 2017. Due to the transfer of the judges, the matter kept on getting adjourned. Taking cognisance of the matter, the District Judge of the court slated the plea for transfer of judge to November 25.

Representing Nirbhaya's parents' in the case, advocate Seema Samriddhi Kushwaha said, "We approached the court when legal remedies of the convicts got exhausted. We are seeking the court's direction to the Tihar Jail authorities to expedite the execution of the rape convicts."

Nirbahaya Rape case

In one of the most horrific rape cases which shook the country, a 23-year-old paramedic student was raped on the intervening night of December 16-17, 2012 inside a running bus in South Delhi by six persons and was severely assaulted before being thrown out on the road. She died on December 29, 2012, at Mount Elizabeth Hospital in Singapore. The Supreme Court had in July 2017 upheld the death sentence for four men – Mukesh (29), Pawan (22), Vinay Sharma (23) and Akshay Kumar Singh (31) – convicted of the rape and murder of the young woman who came to be known as 'Nirbhaya', the fearless.

A fifth accused, Ram Singh, allegedly committed suicide in Tihar Jail in March in 2013 and the sixth, a convicted juvenile was sentenced to three years of punishment in a reform home, and released in 2015. On October 31 the Tihar Jail administration had issued a notice to the convicts asking them to file a mercy plea before the President. As per law, the convicts can seek commutation of death sentence to life imprisonment from the President against the capital punishment awarded to them in the Nirbhaya case.
