In a massive setback for Congress, Vice President Venkaiah Naidu has rejected the impeachment notice against the Chief Justice of India (CJI) Dipak Misra. Naidu has rejected the notice after consultation with legal experts. As per sources, the Congress party will be addressing a news conference over the rejected impeachment motion.

Republic TV has exclusively accessed the Vice-President’s order against the opposition’s move.

  • Point 8 in Page 4 says the “notice of motion is not a fit case for removal of judges.”
  • Point 9 on the same page says the “motion does not deserve to be admitted.”
  • Point 11 on the same page says “MPs who presented petition are unsure of their case...Phrases used by MPs indicate mere suspicion, conjecture or assumption...Does not constitute proof beyond reasonable doubt.”
  • On Page 6, the order says “Internal matter to be resolved by Supreme Court itself...Allegations neither tenable nor admissible...Firm opinion that it is neither legal nor desirable or proper to admit notice on any one of these grounds.’
  • On page 8, the order says “Can't allow any of four pillars of governance to be weakened by any thought, word or action”

Republic TV had accessed the details of recommendations by top legal experts who have slammed the Congress' impeachment move. As per sources, the Vice President had consulted 12 experts.

Meanwhile, senior advocate Prashant Bhushan has slammed the Vice President's move in a scathing tweet. "What!! VP Naidu rejects impeachment motion against CJI signed by 64 RS MPs! On what grounds? He has no power to say that charges are not made out. That's for the inquiry committee of 3 judges. He only has to see if it's signed by >50 MPs & possibly if charges are of misbehaviour," he wrote.

Earlier, the Vice-President had to cut his tour to Hyderabad short and return to New Delhi to begin the process of consultations on impeachment notice against the CJI. 

Naidu had held talks with Attorney General KK Venugopal and also spoke with former Supreme Court judge B Sudarshan Reddy. The Rajya Sabha Chairman also reportedly had asked the Secretariat of the upper house of Parliament to see if there is a precedent on Opposition members giving out details of such a motion to the media before it is examined.

Congress had submitted the impeachment notice against tdhe CJI to Rajya Sabha Chairman Venkaiah Naidu on Friday.
