The petitioner argued that  Inspector Dharmendra Singh Chouhan, who fired Yadav was a relative of the SSP and the SSP is trying to protect Dharmendra. He also argued that the statements made by the policemen in the media were contradictory. The petition says that Pushpendra was killed in a fake encounter and his last rites were performed in absence of family to destroy evidence.
