Jhansi: HC seeks Govt's response on alleged fake encounter case

The Allahabad High Court on Thursday sought Uttar Pradesh Government's response on a writ petition seeking CBI probe into the alleged fake encounter case of Pushpendra Yadav in Jhansi. The court was hearing a petition filed by Yadav's wife through advocate Imran Ullah. After hearing the petitioner's arguments the court asked Jhansi SSP to file the affidavit till November 26. 

Petition accuses SSP 

The petitioner argued that  Inspector Dharmendra Singh Chouhan, who fired Yadav was a relative of the SSP and the SSP is trying to protect Dharmendra. He also argued that the statements made by the policemen in the media were contradictory. The petition says that Pushpendra was killed in a fake encounter and his last rites were performed in absence of family to destroy evidence. In her petition, Yadav's wife said his husband was killed by the police and requested the court for its directions for an enquiry by the CBI.

Police say Pushpendra opened fire

However, the police said that Pushpendra opened fire after seeing the police team in Gursarai area. In police retaliation, Pushpendra was injured after being shot. After being injured, the police took Pushpendra to the district hospital where doctors declared him dead.

Akhilesh Yadav slams Yogi Adityanath

After the incident came to light, former CM and Samajwadi party leader slammed the Yogi Adityanath government for the law and order situation in Uttar Pradesh.  Akhilesh Yadav also said that there should be a judicial inquiry into the incident. Principal Secretary, Home, Uttar Pradesh and state DGP along with the Jhansi SSP have been made respondents in the petition. 

According to NHRC, Uttar Pradesh is on the top in fake encounters cases. A total of 1,241 complaints of encounters had been registered across the country, of which one-third (455) alone were from UP. According to data released by the state government under the present dispensation, police engaged with criminals in 3,896 encounters and arrested 8,904 accused in the process. While 76 criminals were killed, 1,154 others were injured in shootouts since 2017.
