Tabrez Ansari Lynching: Saraikela SP Says 'Murder Not Deliberate'

Jharkhand SP Karthik stated that the mob did not kill Tabrez Ansari, it might have been a factor in his death but his demise was caused by cardiac arrest

In an exclusive interview with Republic TV, Jharkhand Superintendent of Police Karthik S said that they put culpable homicide in the charge sheet in relation with the Tabrez Ansari lynching case after the murder charges were dropped in the purview of the autopsy results. The autopsy results showed that the cause of Tabrez’s death was a result of cardiac arrest.

'11 accused have been arrested'

S Karthik, the SP of Saraikela-Kharsawan in Jharkhand said that although the mob assault was a major component that led to the death of Tabrez Ansari, the mob did not actually kill him. "At the time there were 11 accused that were arrested and once the due process was completed, we filed a timely charge sheet against them. Following which the two remaining accused were also arrested and investigations into their involvement in the incident have begun; once it is completed a charge sheet will be filed against them within the next two weeks,” he added.

Charge sheet filed under Section 304 and not Section 302

“The charge sheet against the 11 accused has been filed under Section 304, which basically means punishment for culpable homicide not amounting to murder, the reason for filing the charge sheet under Section 304 is because the cause of death according to the post mortem report is because the murder was not deliberate”.  

The SP added, they were suspicious at first, “that is why we requested a second opinion from the doctors and we asked for a panel of doctors to be set up at the MGM (Mahatama Gandhi Memorial Hospital in Jamshedpur) and even they were not able to reach a clear decision and due to which we could not file a charge sheet in relation to murder under Section 302”. He further said that between murder and culpable homicide not amounting to murder there is not a lot of difference and punishment-wise in both of them life-term like imprisonment is possible

Ansari's family alleges police had not arranged for proper treatment 

SP Karthik shot down claims made by the victim’s family and stated that the allegations made by them aren’t true, "we are looking into this case and the investigation is being carried out meticulously and very soon all those involved in the case will be punished.” His (Tabrez Ansari) family had alleged that despite appeals, police had not arranged for proper treatment, they were not even allowed to meet him, and that he died long before he was taken to a hospital.
