The BJP will move the vacation bench of the Supreme Court challenging the order of the division bench of Calcutta High Court on BJP's Yatra in West Bengal. The vacation bench will hear the matter on December 24.

The division bench of Chief Justice Debasish Kargupta and Justice Shampa Sarkar on Friday quashed the single bench order and asked it to hear the case afresh to consider intelligence inputs by state agencies. The division bench had also asked the single bench to dispose the case expeditiously

On Thursday, the single bench had set aside the West Bengal government's refusal to allow the BJP to conduct its Rath Yatra programme in the state on apprehensions of 'communal unrest'.

Justice Tapabrata Chakraborty had directed the state BJP to inform the superintendents of police of the districts, in which the rallies shall enter, at least 12 hours ahead of schedule.

The BJP had planned three Rath Yatras from different parts of Bengal, entailing the 'Rath' chariots traveling across the state over a period of a month and a half. After permission was denied, the state BJP had moved the court challenging the state government's denial of permission to its programme.

The party had originally decided to carry a 42-day rally beginning from December 5. BJP President Amit Shah was supposed to flag off the rally. Sources had even said that PM Narendra Modi was supposed to give a speech during one of the rallies.

Amidst the battle over the Yatra between the state government and BJP, Mamata Banerjee, a few weeks ago, had called the BJP's Rath Yatra, 'Ravan Yatra'. 

"The BJP is scaring people into submission by offering crores of rupees, and taking out 'Ravan Yatras' all over the country. They are asking people about their name, caste, gotra, and religion. Seems like someone has given them this responsibility," she said.
