J&K Bifurcated, Amit Shah Tells Pakistan & China Clearly: 'PoK & Aksai Chin Implicitly India'

A day after Rajya Sabha passed the resolution (Jammu And Kashmir (Reorganisation) Bill 2019) to revoke Article 370 with over two-third majority, Home Minister Amit Shah tabled that bill in Lok Sabha for debate and voting on Tuesday. Amid massive war of words between Congress and BJP over the bill in the Lower House, Amit Shah, in his arguments, declared that whenever he speaks about J&K in the Parliament, PoK and Aksai Chin areas have been integral parts of the erstwhile state (With the passing of J&K (Reorganisation) Bill 2019 in Rajya Sabha, Jammu and Kashmir divided into two Union Territories - J&K and Ladakh).

"Jammu & Kashmir is an integral part of Union of India. Kashmir ki seema mein PoK bhi aata hai. Jaan de denge iske liye (PoK comes under the boundaries of Kashmir. We will give up our lives for it)", Amit Shah said.

Addressing the Lok Sabha, Amit Shah clarified that it is mentioned in both Indian and J&K Constitutions that PoK (Pakistan-Occupied Kashmir) and Aksai Chin area are parts of the Jammu and Kashmir. He further added that with J&K being an internal part of Union of India, the Centre cannot be stopped from introducing laws for its people.

"In the Constitution of Jammu and Kashmir, it is specifically mentioned that the state of Jammu and Kashmir is and will be an internal part of the Union of India. This is why no one can stop us (Centre) from bringing up any law or order for the people of Jammu and Kashmir. The Cabinet has the right. And when I speak about Jammu and Kashmir, then PoK (Pakistan-Occupied Kashmir) comes under it. I want to put this on record that whenever I have mentioned 'Jammu and Kashmir' in the Parliament, PoK (Pakistan-occupied Kashmir) and Aksai Chin have been an implicit part of it. In Indian Constitution and J&K's Constitution, PoK and Aksai Chin are an integral part," the Home Minister said. 

Notably, the so-called 'Pakistan Occupied Kashmir' is a part of Jammu and Kashmir. In 1947, Pakistan invaded the area and unlawfully been claiming it as its part. Pakistan-occupied Kashmir (POK) historically belonged to the erstwhile princely state of Jammu and Kashmir, which was acceded into the Indian Union after the signing of Instrument of Accession post-independence by Maharaja Hari Singh of Jammu and Kashmir. POK is legitimately an inherent part of India.

Furthermore, Aksai Chin is also an integral of the Ladakh region of Jammu and Kashmir. However, China and India fought a brief war in Aksai Chin and Arunachal Pradesh in 1962, China claimed that Aksai Chin area to be its part. Later, in 1993 and 1996, the two countries signed agreements to respect the Line of Actual Control.

Article 370 scrapped

Along with the J&K (Reorganisation) Bill 2019, Home Minister Amit Shah proposed to repeal Article 370, that gave special status to Jammu and Kashmir, in the Rajya Sabha. President Ram Nath Kovind exercised his power under Clause 1 of Article 370 to scrap Article 370. With the order, Article 35A, which provided special privileges to “permanent residents" of the state has also been scrapped. Now, people from outside the state can buy property in the state. Earlier, the Article exempted the 'state' of Jammu and Kashmir from following the Indian Constitution except for Article 1 and itself. It also restricted Parliament's legislative powers in the 'state'.
