Major furore breaks out after Triple talaq bill tabled in 17th Lok Sabha; Congress opposes legislation

A fresh bill to ban the practice of instant Triple Talaq has been introduced in the 17th Lok Sabha by Patna Sahib MP and Union Law Minister Ravi Shankar Prasad on Friday.

A fresh bill to ban the practice of instant Triple Talaq has been introduced in the 17th Lok Sabha by Patna Sahib MP and Union Law Minister Ravi Shankar Prasad on Friday. However, the Congress party-led by Thiruvananthapuram MP Shashi Tharoor has opposed the introduction of the bill in the Parliament. 

Opposing the Bill, Congress leader Shashi Tharoor said:

"This bill conflicts Civil law and criminal law by criminalising the act of Triple Talaq, which is an irregular form of divorce already null and void in our country post the decision of SC in Shayara Bano vs Union of India."

Furthermore, Kollam MP and RSP leader NK Premachandran also opposed the bill passed by the BJP party in Parliament.

Backing the two leaders, Hyderabad MP and AIMIM chief Asaduddin Owaisi also opposed the introduction of the bill, giving the 'violation of Article 15 and 16' one of the reason. 

"The new bill will not empower the women," said AIMIM chief Owaisi in his argument opposing the bill. 

Following the objection by the Opposition leaders over the introduction of Triple Talaq bill, a ruckus broke out in the Lok Sabha. 

The Muslim Women (Protection of Rights on Marriage) Bill, 2019, was listed in the Lok Sabha's agenda. The previous NDA-led government had promulgated the ordinance on triple talaq on two occasions in September 2018 and in February 2019, while the bill remained pending in the Rajya Sabha, even after being passed by the Lok Sabha.

With the dissolution of the 16th Lok Sabha last month, the previous bill had lapsed as it was pending in the Rajya Sabha.

Under the Muslim Women (Protection of Rights on Marriage) Ordinance, 2019, proposed by the Centre, divorcing through instant triple talaq will become illegal, void and will attract a jail term of three years for the husband. It had faced huge objections from the opposition parties over various grounds.
