US Judge: 'Trump can't sue AG in court to stop release of tax returns'

US Federal Judge on November 11 dismissed New York's attorney general and state tax commissioner as defendants in US President Donald Trump's lawsuit.

US Federal Judge on November 11 sent away New York's Attorney General and State tax commissioner as defendants in US President Donald Trump's lawsuit looking to block a House of Representatives committee from obtaining his New York state tax returns. According to the reports, it is one such case where the President or his administration has requested the federal judges to interfere before the House Democrats acquire Trump's financial records. The US District Judge Carl Nicholas said that he lacked jurisdiction over Letitia James, the attorney general, and Michael Schmidt, commissioner of the state's Department of Taxation and Finance.

Trump likely to push his claims against the officials

He said on Monday, November 11, that if Trump wants to carry on to challenge a New York state law that states Congress can request his state tax returns, he will either have to wait for Congress to make the request or can file a new lawsuit in a New York court. Nichols gave his opinion that he dismissed Trump's lawsuit against the New York state officials. His opinion said Trump may push his claim against the officials in the court keeping in mind that future events support the exercise of personal jurisdiction over them or he may choose to put those claims in an appropriate legal forum.

Trump sued the US House Ways and Means Committee

Trump also sued the US House Ways and Means Committee and the judge ordered the defendant's lawyers and the plaintiff's attorney to exchange opinions and lodge a joint status report highlighting how they would like to proceed. New York passed a new law earlier this year that would allow the congressional committee to access Trump's state tax returns.
On the other hand, Trump's lawyers filed a lawsuit in July arguing that the new law violates his freedom of speech rights. This lawsuit is one of the several court fights over access to Trump's tax returns. The previous week, a New York court ordered that Trump's accounting firm must hand over eight years of his tax returns to New York prosecutors. Trump's lawyers have said that they will carry forward the case to the US Supreme Court.
