UP RERA mandates sale of housing units on carpet area basis

Real estate news: The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) issued a directive on Wednesday, instructing housing project developers in the state to sell units or apartments based solely on carpet area. According to UP RERA Chairman Sanjay Bhoosreddy, the move is in adherence to the provisions of the RERA Act and legal agreements, dismissing the concept of 'Super Area.'
The statement from UP RERA emphasises that the sale of apartments on any basis other than carpet area will be deemed illegal. The RERA Act stipulates that the buying and selling of apartments is legally recognised only when transacted based on the carpet area.
"There is no abbreviation or definition of Super Area in the RERA Act. It is indeed necessary for allottees to consider Carpet Area as the actual area of the unit or apartment and pay the promoter according to this area," stated Sanjay Bhoosreddy.
Under the RERA Act of 2016, promoters are required to disclose the number and types of units, along with details such as floor space, balcony, terrace, and other areas when registering a project on the portal. The actual area within internal walls, known as the Carpet Area, is explicitly mentioned.

To facilitate transparent transactions, a model agreement for sale between promoters and allottees has been provided on the UP RERA portal, and it is also based on carpet area. Selling units based on the concept of 'Super Area' is deemed contrary to the provisions of the RERA Act, and UP RERA warns that violations may result in legal action against promoters.
The directive underscores UP RERA's commitment to enforcing the standardised and legal framework for property transactions, promoting transparency and fairness in the real estate sector.
