New Delhi: The Delhi Police has lodged a first information report (FIR) in the the assault case of Swati Maliwal in which Bibhav Kumar has been named as the accused. The FIR was registered after Maliwal's statement was recorded by a two-member team, led by Additional Commissioner of Police PS Kushwaha. Rajya Sabha MP Swati Maliwal was allegedly assaulted by Bibhav Kumar, the aide of Delhi Chief Minister and AAP convenor Arvind Kejriwal at the CM's residence in the national capital on Monday, May 13. 

After the alleged incident, Swati Maliwal had called the Delhi Police. However, no formal complaint was lodged. She had told the Police that she would return to lodge a case. In an exclusive conversation to Republic, her mother revealed on May 15 that Swati was not in a position to speak after the incident. It was alleged that Swati Maliwal was being forced to remain silent, until may 16 when she filed an official complaint with the Delhi Police.

The development comes two days after Swati Maliwal went to the police station and alleged that a member of Kejriwal's personal staff "assaulted" her at the CM's official residence. The Bharatiya Janata Party (BJP) has hit out at the AAP supremo for maintaining silence over the incident. Maliwal was taken for medical examination at the All India Institute of Medical Sciences (AIIMS) Delhi on Thursday night.

In her latest post on X, Swati Maliwal has alleged that someone is tampering with the CCTV footage of the CM's house, where the alleged incident occurred. “मुझे सूचना मिली है कि अब ये लोग घर के CCTV से छेड़छाड़ करवा रहा है..” (I have received information that now these people are tampering with the CCTV of the house.)

Bibhav Kumar has lodged a complaint against Swati Maliwal at the Civil Lines police station via email. “Complaint against Ms. Swati Maliwal for illegal/ unauthorized entry into and creating a security breach by trespassing at the Chief Minister’s residence; for creating a ruckus and interfering with public servants in discharge of duty.”

Delhi CM Arvind Kejriwal refused to answer to Republic when confronted about Swati Maliwal in Mumbai.

  • Delhi Police has not received Bibhav Kumar's complaint

The Delhi Police has not yet received the complaint copy from Bibhav Kumar. The update comes after AAP leader Atishi claimed in her press conference today that Bibhav Kumar had complained to the Delhi Police regarding the Swati Maliwal incident of May 13.

Swati Maliwal attacked her alleged assaulter Bibhav Kumar in her latest post on social media. She wrote in Hindi, “पार्टी में कल के आए नेताओं से 20 साल पुरानी कार्यकर्ता को BJP का एजेंट बता दिया। दो दिन पहले पार्टी ने PC में सब सच क़बूल लिया था और आज U-Turn ये गुंडा पार्टी को धमका रहा है, मैं अरेस्ट हुआ तो सारे राज़ खोलूँगा। इसलिए ही लखनऊ से लेकर हर जगह शरण में घूम रहा है। आज उसके दबाव में पार्टी ने हार मान ली और एक गुंडे को बचाने के लिए पूरी पार्टी से मेरे चरित्र पर सवाल उठाए गए। कोई बात नहीं, पूरे देश की महिलाओं के लिए अकेले ही लड़ती आई हूँ, अपने लिए भी लड़ूँगी। जमकर करैक्टर असैसीनैशन करो, वक़्त आने पर सब सच सामने आएगा!” (The leaders who joined the party yesterday declared a 20-year old worker as a BJP agent. Swati Maliwal was seen leaving CM Arvind Kejriwal's residence after reportedly recreating the crime scene in the drawing room with the Delhi Police.

The Delhi Police has brought Swati Maliwal to CM Arvind Kejriwal's official residence in the national capital in order to recreate the scene of the alleged assault.

  • Atishi LIVE press conference

AAP leader and minister Atishi held a press conference today, where she called out Swati Maliwal against her complaint of assault by Bibhav Kumar. Atishi mentioned a video of Swati Maliwal that the AAP had re-posted on X today, in which Swati Maliwal is not seen in a condition that she claimed to be in after her alleged assault. Atishi said that on the morning of May 13, Swati Maliwal reached the Delhi CM's residence without an appointment. When the security guards stopped Swati Maliwal at the gate, she threatened the guards and police officers present, said Atishi. The AAP minister further said that Swati Maliwal sneaked into the Chief Minister's house and demanded to meet him immediately. Atishi questioned the intentions of Swati Maliwal on her unscheduled visit to the CM's residence. When Bibhav Kumar told Swati Maliwal that the CM is not available at the moment, she still tried to get into the house, said Atishi. This proves that this is a conspiracy of the BJP against Arvind Kejriwal, claimed Atishi. "Swati Maliwal's allegations are totally false," said Atishi in the press conference.

Top jurist and Rajya Sabha MP Mahesh Jethmalani spoke to Rhythm Anand Bhardwaj, Executive Editor - Law & Governance at Republic Media Network on the Swati Maliwal assault case. Jethmalani was alarmed at the incident. He said that the apathy shows the “attitude of all the parties concerned, the character of its people and the hypocrisy of the women MPs of the INDI alliance”.

"One Rajya Sabha MP gets brutally assaulted at the CM's residence. Where are those women MPs who were voicing for the women in Manipur? Where are they? I condemn what happened in Manipur, but do they have the courage to condemn this incident or their political prospects in the poll are more important than the dignity of a woman?" said Jethmalani about the Swati Maliwal case.

"Justifying the assault and victim-shaming are more unfortunate and show the character of INDI alliance parties. Not a single leader has spoken out for the complainant. Instead, character assassination is going on…The nation must observe the silence of INDI alliance,” he concluded.

The Delhi Police team along with the FSL team visited the CM Arvind Kejriwal’s residence today. The FSL team of the Delhi Police will investigate the sequence of the incidents on the basis of closed circuit television (CCTV) footage.

Attacking Swati Maliwal after her charges of assault against Bibhav Kumar, the Aam Aadmi Party posted her video on the official AAP handle on social media, where she is heard arguing with a person from the party. “I will make sure you lose your job if you touch me,” Swati Maliwal is heard saying. AAP said on X in Hindi, “Swati Maliwal ka sach” (The truth about Swati Maliwal).

In an unrelated update to the Liquorgate scam allegedly involving Arvind Kejriwal, the Enforcement Directorate (ED) is likely to named Arvind Kejriwal as the prime accused in the case.

  • Maliwal says 'political hitman' trying to save himself

The "political hitman" has started making efforts to save himself, AAP Rajya Sabha MP Swati Maliwal said as purported CCTV footage from CM Kejriwal's residence surfaced. "Like every time, this time also this political hitman has started making efforts to save himself," Maliwal said in a post on X.

The National Commission for Women said, “Today also we had gone to serve notice to Bibhav Kumar but the female inside didn't open the gate. So we have stick the notice of hearing on the gate.”

A team of Delhi Police team has arrived at the residence of CM Kejriwal's aide Bibhav Kumar. On Thursday night, an FIR was registered in connection with the assault on Swati Maliwal after she filed a complaint with the police.

  • What Are the Charges Against Bibhav Kumar? 

The FIR was registered after Maliwal's statement was recorded by a two-member team, led by Additional Commissioner of Police PS Kushwaha. It was at the Rajya Sabha member's residence in Central Delhi for nearly four and a half hours since 1.50 pm. An FIR has been registered at the Civil Lines police station against Kumar under Indian Penal Code sections 354 (assault or criminal force on a woman with intent to outrage her modesty), 506 (punishment for criminal intimidation), 509 (word gesture or act of intent to insult) and 323 (assault), reported PTI.

Late on Thursday night, Swati Maliwal was taken for a medical examination at the All India Institute of Medical Sciences (AIIMS) Delhi.

Delhi Police lodged a first information report (FIR) in the Swati Maliwal case on May 16, after she filed a complaint. Swati Maliwal alleged that Bibhav Kumar assaulted her physically at the residence of Delhi CM Arvind Kejriwal on May 13, hitting her on the chest, face, stomach, and lower part of her body. She also alleged that he verbally abused her in Hindi and threatened her. As per sources, the FIR had the following details given by Swati Maliwal

- CM Kejriwal was present in the house.
- I went to the drawing room and was waiting there.
- Bibhav came and started abusing.
- Slapped without provocation kept hitting
- I made noise and said leave me, let me go
- Kept beating continuously and abusing in Hindi.
- Kept threatening - we will see, we will settle it.
- Hit the chest.
- Hit the face.
- Hit the stomach.
- Hit the lower part of the body.
* I said I am on periods.
* I am in a lot of pain, please leave me.
* I ran out.
* Came out and called the police.

After filing the police complaint, Swati Maliwal posted a message on social media platform X in Hindi, saying that what happened to her was very bad but that she is not important in the midst of such an important event in the country right now as the Lok Sabha Elections 2024.

Swati Maliwal said on X, “मेरे साथ जो हुआ वो बहुत बुरा था। मेरे साथ हुई घटना पर मैंने पुलिस को अपना स्टेटमेंट दिया है। मुझे आशा है कि उचित कार्यवाही होगी। पिछले दिन मेरे लिए बहुत कठिन रहे हैं। जिन लोगों ने प्रार्थना की उनका धन्यवाद करती हूँ। जिन लोगों ने Character Assassination करने की कोशिश की, ये बोला की दूसरी पार्टी के इशारे पर कर रही है, भगवान उन्हें भी खुश रखे। देश में अहम चुनाव चल रहा है, स्वाति मालीवाल ज़रूरी नहीं है, देश के मुद्दे ज़रूरी हैं। BJP वालों से ख़ास गुज़ारिश है इस घटना पे राजनीति न करें।”

Earlier on Thursday, sources told Republic that Swati Maliwal has been given protection by the Central Reserve Police Force (CRPF) after she filed a police complaint against AAP leader Bibhav Kumar for assaulting her.

Swati Maliwal filed a police complaint today after the Delhi Police reached out to her at her house to take her statement. In her written complaint, she asked for appropriate action to be taken against Bibhav Kumar.

  • NCW summons Bibhav Kumar

On May 16, the National Commission for Women (NCW) summoned Bibhav Kumar in the case. Bibhav Kumar has been asked him to appear before the NCW on May 17.
