Court says CBI can arrest Rajeev Kumar without Non-Bailable Warrant

The Alipore Court has reserved orders on a petition filed by the CBI on a non-bailable warrant to arrest former Kolkata Police Commissioner Rajeev Kumar saying that it was not needed to apprehend him. It has said that the CBI has got the full right to arrest Rajeev Kumar and that if CBI is manhandled they can come to court. The Alipore court informed the CBI that Rajeev Kumar can be arrested under Section 41 of the CrPC without a warrant. The court observed that the High court had also said that if CBI feels the need to arrest him they can without warrant.

CBI's manhunt for Rajeev Kumar

Mounting pressure on Kolkata's former top police officer Rajeev Kumar, the Central Bureau of Investigation (CBI) on Thursday, searched at five locations around Kolkata to hunt down Kumar and bring him in for investigation in connection with the Saradha Chit fund case. Sources report that the CBI is also searching for Rajeev Kumar's residence in Kolkata. The CBI, as per sources, served him notice at his residence under section 160, summoning him. Kumar had earlier failed to appear before the agency on Monday. The CBI began the manhunt after Kumar failed to turn up after being summoned by the probing agency.

CBI raids five locations in West Bengal

Sources report that simultaneous raids have been conducted at Rajeev Kumar's official residence, the IPS Mess, the Taj Gateway Hotel and the Taj Vivanta Hotel in Kolkata. Kumar who was the former police Commissioner of Kolkata is currently the Additional Director General (ADG) -CID. Earlier in the day, the CBI had written to the West Bengal Director General of Police (DGP) seeking information about Kumar. Two teams have been constituted by the CBI to search Rajeev Kumar.

Prior to this move, Kumar was also asked to appear in front of the agency on Saturday. He failed to do claiming that he needs one-month time to appear as his wife is unwell. The development in the case came in quick succession after the Calcutta High Court on September 13 withdrew its order of interim protection from arrest for Rajeev Kumar. Rajeev Kumar has been summoned several times prior to this by the agency. He has already been questioned for two consecutive days by the agency.

What is Rajeev Kumar's involvement in Saradha case?

The Kolkata Police Commissioner was heading the SIT formed by WB Government to probe the Saradha Chit fund case previously. When the case was handed over to the CBI, the agency stated that Kumar was being allegedly evasive about missing pieces of evidence in relation to the probe. Following this charge, in February 2019, a team of CBI officials arrived at Rajeev Kumar's residence to arrest him. While attempting to arrest the former top cop, West Bengal Chief Minister Mamata Banerjee staged a dharna opposing the arrest of the Police Commissioner by the CBI, citing a violation of the constitution.
