SC: 'Collegium has taken the decision on Justice Kureshi's elevation'

The Supreme Court on Monday has announced that collegium has taken the decision on Justice Kureshi's elevation as the Chief Justice of the Madhya Pradesh HC.

The Supreme Court on Monday has announced the decision to elevate Justice Akil Kureshi as the Chief Justice of the Madhya Pradesh High Court. Ranjan Gogoi, the Chief Justice of India has stated that the decision will soon be updated on the apex court's website. The apex court had earlier mentioned that it was notified of the Ministry of Law and Justice on the Collegium's recommendation. The recommendation was to elevate Justice Kureshi as the Chief Justice of the MP High Court.

GHCAA on the Centre 

The Gujarat High Court Advocates Association (GHCAA) has filed a petition claiming that Justice Kureshi's name was recommended by the Collegium on May 10. However, GHCAA states that the name of Justice Kureshi was not notified by the Centre even after the Collegium recommended it. However, on August 16, the Centre notified the apex court that it would take action on the recommendation of the Collegium. In the past, the apex court had asked the Centre to take a call in the matter by August 14 after Solicitor General Tushar Mehta had informed the bench that the collegium's proposal was under consideration.

Other appointments

The association has alleged that the Centre has cleared appointments of Chief Justices in other High Courts. The petition points out the appointment of 18 other additional judges of different High Courts that have happened after May 10. The association, in conclusion, states that inaction on the part of the Centre to appoint Justice Kureshi as Chief Justice of MP High Court was violative of Articles 14 and 217 of the Constitution. Furthermore, adding that inaction on the part of the Centre violates the independence of the Judiciary, lowering the precedence of the Judiciary in the matters of appointment and transfer of the judges. Yatin Oza, the GHCAA President in a statement has reportedly stated that Justice Kureshi is being singled out as a consequence of an order being passed by him in 2010 driving Amit Shah, current Union Home Minister to police custody.
