After sensational CBI vs Kolkata police drama, action shifts to Supreme Court; Mamata Banerjee still on dharna: LIVE Updates

Following the face-off between CBI and Kolkata cops over the investigative agency wanting to question Kolkata CP Rajeev Kumar in connection with the Saradha scam, West Bengal CM Mamata Banerjee will continue her dharna against "Centres attempt to stifle Constitution and Federalism". The CBI, on the other hand, will move the SC over the matter. Follow LIVE updates here.

CBI seeks files plea seeking initiation of contempt of court proceedings against Kolkata officials, including top cop Rajeev Kumar, for obstructing chit fund probe, seeks urgent hearing 

CBI in its petition says Kolkata Police Commissioner Rajeev Kumar was summoned multiple times but failed to cooperate and created hurdles in the investigation.

Inside the courtroom, Solicitor General Tushar Mehta representing CBI:

"We were ready to move Supreme Court at night. Electronic evidence are being destroyed. Summons were issued to Rajeev Kumar, he’s a potential accused and he has not responded to them. Two applications were made by us - tampering of evidence and a contempt plea. 

"Rajeev Kumar is a potential accused.

"Uniformed officers sat on dharna with a political party."

SG Tushar Mehta asked for the case to be taken up on Monday at 2 pm. He said that the evidence are being destroyed.

Chief Justice of India Ranjan Gogoi after hearing CBI plea says:

"It’s electronic evidence (in Saradha scam), it can be retrieved. If you can put any piece of evidence that Rajeev Kumar is doing something, we will come down very heavily on him. During the course of the day you’re free to come to us with any evidence."

Abhishek Manu Singhvi who is representing West Bengal government argues that there is no FIR against Kumar.

CJI lists the matter for Tuesday at 10.30 am.

An all-out war had broken between the Centre and the Mamata Banerjee government on Sunday, with West Bengal CM sitting on a dharna over CBI's attempt to question the Kolkata Police chief in connection with the Saradha scam. She has alleged that the Centre stifled the spirit of "Constitution and federalism".

The TMC chief claimed that the CBI knocked on the doors of Kolkata Police Commissioner Rajeev Kumar without a search warrant. Kolkata CP, State Security Adviser, ADG ( Law and Order)  and other Senior Kolkata police officers have also joined Mamata Banerjee in her dharna. 

In the tussle between the CBI and the Kolkata cops, five CBI officers were detained by police after they arrived at the residence of Kolkata Police Commissioner to investigate him, though they were later released. 
The Opposition supported of Mamata, and some of the leaders are likely to join her. Mamata will hold a cabinet meeting at 10:00 am from the dharna sthal. CBI Chief Nageshwar Rao has alleged that the CBI has evidence against Rajeev Kumar. 
The investigative agency will move the Supreme Court on Monday morning against West Bengal police for detaining CBI officials who were carrying out probe into chit fund scam as directed by apex court. 
SG Tushar Mehta will mention the CBI plea before CJI Ranjan Gogoi, Congress leader Abhishek Manu Singhvi will be represented the Bengal government.

The TMC has said they will raise the demand of 'Modi has to go' in the Parliament. It has claimed the CBI's action against Kolkata top cop as BJP's constitutional coup. The TMC has asked for support from the Opposition parties. The party will also take out a rally over the matter.
