Senior Advocate HS Phoolka who has been fighting cases for victims of 1984 anti-Sikh riots said on Friday that following the 2012 movement, AAP should not have been formed.

"When I look back I have learnt a lot in the five years of my political career. When I became Leader of Opposition, the bar association said that I cannot fight 1984 case after which I quit the position of the Leader of Opposition and fought the case. As you know that I am not working actively for AAP since the last year. I think the decision to form a political party from 2012 anti-corruption movement was not the right decision. The movement should have continued though," he said

Saying that the "big fish" are still roaming free, he said, "We have to send people like Kamal Nath and Jagdish Tytler behind the bars," he said.

Taking to Twitter, Phoolka announced his resignation from AAP on Thursday. He also said that AAP chief Arvind Kejriwal did not ask for his resignation.

"I will do a press conference at 4 pm tomorrow at the press club and I will reveal the reason why I am resigning... Have no plan to join BJP or Akali," he said.

A controversy broke out in December over reports of a resolution being passed in the Delhi Assembly calling for Rajiv Gandhi's Bharat Ratna to be revoked.

Soon after the news broke, AAP backtracked saying the resolution was never passed. AAP also said that they only passed a resolution on calling the 1984 Anti-Sikh riots a genocide.

Delhi Deputy CM Manish Sisodia said:

"We are not saying that the Bharat Ratna given to Rajiv Gandhi should be returned. Those whose hands are red with the blood of 1984 and 2002 should not do this kind of politics. Yes, it was a proposal by a member but it was never passed a resolution. It was not expunged because it was not brought up in the assembly," he said.

MLA Alka Lamba had even said that she was being coerced to follow the party line to support the resolution on demanding the revocation of the ban. She even said that she would resign if the party asked her to.

Revealing that she received official documents wherein proposal to take away former PM Rajiv Gandhi's Bharat Ratna was clearly stated, Alka Lamba later professed that she did not know why AAP spokesperson

The party reacted saying that the reports which claimed that its MLA Alka Lamba was asked to resign over differences of opinion on the issue.
