India to send evidence against Mehul Choksi to Antigua, proving he misrepresented his case to get Antiguan citizenship: Top govt sources

After Antigua said it is ready to change its extradition treaty and deport Mehul Choksi, government sources have told Republic TV that India is likely to send documentary evidence in next few days that Choksi misrepresented his case to get citizenship. The sources have also revealed that the government is going to seek revocation of Choksi's citizenship and could send across the documents as early as next week.

India is sending evidence against Choksi after the Antiguan authorities said, "We will wait for India to furnish details and once it is determined that the charges are proper we will have no choice but to act on it."

"If India can prove that at the point of answering questions in the application he knew and withheld deliberate information, then that is grounds for revocation. The law is very clear: If the applicant fails to provide material information at the point of application and this is covered somewhere in the future, that is basis of laws enough to do a verification," the authorities added.

Republic TV has also learnt that India has enough evidence to prove that Choksi hoodwinked Antiguan authorities anticipating Indian crackdown. Subsequent to Indian request for revocation of Mehul Choksi’s Antiguan citizenship, he won’t be able to use the new passport to travel anywhere.

Earlier on July 31, reports surfaced that Mehul Choksi approached the Antigua High court in an attempt to block extradition to India. Mehul Choksi’s lawyer,Dr. David Dorsette, filed a case in the High Court of Antigua on Monday seeking to block the extradition of his client.

He asked for a declaration from the Court that Choksi is, by virtue of Section 119.1 of the Constitution a citizen of Antigua and Barbuda; and that no lawful basis exists for the extradition of Choksi under Section 5 of the 1993 Extradition Act.

Earlier, Republic TV spoke to Antigua PM Gaston Browne who had confirmed Mehul Choksi's presence in the country and also elaborated on the notices issued regarding the absconding fraudster and the circumstances behind his citizenship application.
