Porsche Case: Rich Brat's Father Charged With Cheating, to Remain in Jail Till June 7

New Delhi: Vishal Agarwal, father of a 17-year-old brat who crushed two techies to death in Pune's Kalyan Nagar area with his Porsche, has been sent to judicial custody till June 7.  Besides, five other accused were also remanded to 14-day custody. For the unversed, the prosecution had requested an extension of their police custody for further investigation. The accused include the owner and employees of two liquor-serving establishments where the teenager allegedly consumed alcohol before his Porsche struck and killed two software professionals on a motorbike.

Vishal Agarwal Charged With Cheating

Vishal Agarwal, the father who was arrested 24 hours after his son, while drunk, ran over two techies in a ₹2.5 crore Porsche sports car, has also been charged with cheating under Section 420 of the Indian Penal Code. 

This charge, which carries a maximum jail term of seven years and a fine, pertains to an unpaid registration fee of ₹1,758 for the Porsche. The vehicle, which was involved in the collision that killed Aneesh Awadhiya and Ashwini Koshta, was purchased in the name of Brahma Ledgers but was never registered, according to the police.

  1. Addressing a presser, Pune police chief Amitesh Kumar said that there was an attempt to tamper with evidence to show that the Porsche that ran over two people on a motorcycle was being driven by a family driver and not the 17-year-old who is in custody over their deaths.
  2. There were attempts to make it appear as if the adult driver was driving the car, but that bid was foiled, Police Commissioner Amitesh Kumar told reporters.
  3. “We have the CCTV footage of him (juvenile) drinking liquor in the pub. The point of saying this is that our case is not alone depending on the blood report as we have other evidence also,” the officer said.
  4. "He (juvenile) was fully in his senses, He had full knowledge that due to his conduct, such an accident, where section 304 is applicable, can happen,” Kumar said.
  5. On the allegations of preferential treatment given to the juvenile, Kumar said an ACP rank officer is investigating the claim. On reports of the juvenile being served pizza after the incident, Kumar said, “We have clearly said that a pizza party didn't happen in the police station. But yes, something had happened on which we have initiated an internal investigation.” "We are trying to make this a water tight case. We have already filed a case against the father of accused and the bar owners. The technical analysis of the evidences is underway," he said.

He said an internal inquiry has pointed to lapses on the part of some cops while registering the case and action will be taken against them for destruction of evidence. “During our investigation, it has clearly emerged that the juvenile was driving the car and we have already collected all the necessary chronological evidence. For example, when the juvenile left the house, the entry on the security register shows that he left with the car,” he said.
  7. On the basis of technical and CCTV evidence, it is confirmed that the car was being driven by the juvenile, the police chief said.
  8. Eyewitnesses have also corroborated that the teenager, son of real estate developer Vishal Agarwal, was driving the Porsche at the time of the accident, he said.

Kumar said attempts were made to show that an adult, the family driver, was at the wheel and not the teen when the vehicle fatally knocked down two persons in Pune’s Kalyani Nagar area around 3 am on Sunday. “We are investigating these things and will take action against those who made such attempts, under section 201 (destruction of evidence) of the IPC,” he said.

He, however, defended Vadgaon Sheri NCP MLA Sunil Tingre, who had allegedly intervened to ensure that the juvenile gets favourable treatment from police.  Kumar said, “He (Tingre) had come to the police station, but it won’t be correct to say that the direction of the police investigation was impacted due to this.”
