Washington DC: Amid the ongoing controversy over Elon Musk's 13th child, influencer Ashley St Clair has filed a paternity suit against the tech mogul seeking sole custody of their five-month-old son and legally established him as the father of the child.

In the legal documents submitted to the Manhattan Supreme Court on Friday, Clair claims that Musk has not been involved in the child’s life, having only met the baby three times—twice in Manhattan and once in Texas. She also alleges that Musk has not asked to see the child or requested any photos of him.

The court filings include a photo of St Clair holding her baby, alongside text messages that are said to have been exchanged between her and Musk.

According to a screenshot of a conversation, Clair sent a picture of herself and the newborn baby to a contact saved in her phone as "EM," which replied, "All well?"

To this, St Clair responded, "He is perfect."

The latter then replied, "I look forward to seeing you and him this weekend... Falling asleep. Hope the recovery goes well."

However, in another message, the "EM" allegedly wrote, "However, in another message," after which the influencer replied by sending her a picture of herself.

When Clair raised communication concerns, the person replied, "Hmm ok... Well, I do have a legion of kids to make."

St Clair told the court that she left Musk's name blank on the child’s birth certificate due to safety concerns, citing his claim of receiving "credible death threats every day."

According to St Clair's representative, Brian Glickich, she made several attempts to collaborate with Musk before resorting to legal action. She has filed a paternity petition alongside her custody petition, despite acknowledging Musk as the father of her child.

In the petition, St Clair claims that Musk was absent during the birth of their child and has only met him three times, showing no involvement in his upbringing. St. Clair alleges that Musk met their son for two hours on September 21 and an hour the following day. The last visit took place on November 30, where Musk spent just 30 minutes with the child.

St. Clair and Musk reportedly began their relationship in May 2023, and the child was conceived in January 2024. St. Clair is now demanding that Musk publicly acknowledge his 13th child.
