Wisconsin Gov: Trump's election suit is "without merit"

President Donald Trump filed a lawsuit Tuesday in Wisconsin seeking to disqualify more than 221,000 ballots in the state's two most Democratic counties, a longshot attempt to overturn Joe Biden's win in a battleground state he lost by nearly 20,700 votes.

Trump filed the day after Democratic Gov. Tony Evers and the chairwoman of the Wisconsin Elections Commission certified Biden as the winner of the state's 10 Electoral College votes. Trump asked the Wisconsin Supreme Court to take the case directly, rather than have it start in a lower court, and order Evers to withdraw the certification.

Democratic Gov. Tony Evers said the lawsuit was "without merit" on Tuesday.

The Wisconsin Supreme Court gave Evers until 8:30 p.m. Tuesday to respond to the lawsuit, an unusually tight deadline that speaks to how quickly the court is likely to decide the case.

Also Tuesday, Wisconsin reported 107 new deaths from COVID-19 on Tuesday, which marked a single-day high for the state and raised its total since the pandemic started to 3,420.

The seven-day average of new daily positive cases, while still four times higher than three months ago, is trending downward.

Andrea Palm, Secretary-designee of Wisconsin Department of Health Services, suggested taking a "wait and see" approach.

"We certainly saw less demand for testing over the long holiday weekend. And we we had fewer testing community testing sites available over the weekend," she said. "So I think we need to we need to hold a little bit, see how the numbers reveal themselves to us over the coming couple of weeks."
