New Delhi: The Supreme Court Collegium on Monday recommended the repatriation of Justice Yashwant Varma, who is being investigated in connection with a cash scandal, to the Allahabad High Court. In a brief three-line statement, the Supreme Court of India ordered the transfer of Delhi High Court Judge Justice Yashwant Varma to the Allahabad High Court. This decision comes despite the Allahabad High Court Bar Association passing a resolution seeking Justice Varma’s impeachment and urging Chief Justice of India (CJI) Sanjiv Khanna not to transfer him to Allahabad or any other court.
The Supreme Court's statement mentioned that the Collegium, during its meetings held on March 20 and 24, 2025, recommended the repatriation of Justice Yashwant Varma, a judge of the Delhi High Court, to the High Court of Judicature at Allahabad.
The Collegium once again recommended Justice Yashwant Varma's transfer to the Allahabad High Court even after it objected to its decision and said that they are not a dumping ground.
Earlier today, Allahabad High Court Bar Association President Anil Tiwari demanded that all the past judgements made by Justice Yashwant Varma should be reviewed so that the public confidence can be restored and added that the judge must remain under a close scrutiny of the Supreme Court till the proceedings are concluded in this case.
"The CJI has been requested not to transfer Justice Yashwant Varma to Allahabad High Court or any other court because no court is a dumping ground. He should remain in Delhi under the close watch of Supreme Court until the completion of the proceedings. The second request is that all judgments given by Justice Varma during his tenure as a judge should be reviewed and scrutinized to infuse public confidence again," Anil Tiwari said, after the Allahabad High Court Bar Association passed a resolution to impeach Justice Varma.
Anil Tiwari further said, “We have requested the CJI to permit CBI and ED to lodge an FIR and proceed with a formal investigation... We have also raised an issue of Uncle Judge syndrome. The concept is that the family members of those judges who are practising in a particular court should not remain in that court. They should go outside to infuse the public confidence and to ensure transparency.”
Justice Varma's transfer was also questioned by top legal eagles and members of the judicial fraternity who said that he should have been asked to resign or impeached because the case is very serious.
Meanwhile, the Delhi High Court has withdrawn all the judicial work from Justice Yashwant Varma, on the directions of Chief Justice of India, as he's being probed in Indian judiciary's biggest cash scandal.
On Saturday, Supreme Court released Delhi High Court Chief Justice Devendra Kumar Upadhyaya's report on Justice Yashwant Varma's alleged cash scandal case. The report, which consisted of 25-pages, included documents, photos and videos of the fire incident at the judge's residence in Delhi showing sacks of cash being burned.
