After Supreme Court pronounced its verdict in favour of Arvind Kejriwal-led Delhi government on the control of administrative services in the national capital, Delhi CM Arvind Kejriwal has sought time from L-G Vinai Kumar Saxena to meet him. In a unanimous verdict, the Constitution bench has said that the elected government must have control over officers barring public order, Police, and land. The bench has ruled that L-G cannot have all-encompassing administrative supervision over all issues relating to UT of Delhi and said LG's powers do not empower him to interfere with the legislative powers of the Delhi assembly and elected government.

The Supreme Court today held that the Delhi government has control over administrative services in the National Capital, excluding matters relating to public order, police, and land. 

CJI DY Chandrachud said, "It has to be ensured that governance of states is not taken over by the union. While NCTD is a Union Territory, it remains a federal entity. The executive power of a Union in a state over matters on which both union and states can legislate is limited to ensure that the governance of the state is not taken over by the union. This would completely abrogate the federal system of governance and the principle of representative democracy. In a democratic form of govt, the real power of administration must rest on the elected arm of the government." 

"The legislative assembly of NCTD embodies the principle of representative democracy. They are elected members. Article 239AA must be interpreted in a manner to further the interest of representative democracy," said CJI DY Chandrachud 

He said, "The phrase "in so far as" in Article 239AA cannot be interpreted in a restrictive manner. Article 239AA establishes legislative assembly of NCTD. It is selected by electorate of Delhi."

CJI DY Chandrachud said, "Article 239AA stipulates legislative power of Delhi Govt is excluded with respect to specified lists. entries 1, 2 and 18 of list 2(public order, police and land).The legislative structure is to exclude only specified entries from the power of the legislative assembly of GNCTD."

CJI DY Chandrachud reading out the judgment : It is a unanimous judgment.

CJI DY Chandrachud said, "This case deals with the asymmteric model of federal governance in the country. The issue is who will have the power to control administrative services in Delhi, whether the Delhi Govt or the LG, representing the Union Govt."

As the Supreme Court continues hearing the batch of petitions on legalizing same-sex marriage, the Central government said that three states had opposed the move.
