CBI Challenges Delhi HC's Order Granting Bail To Kuldeep Singh Sengar In Unnao Rape Case | Image: ANI

New Delhi: The Central Bureau of Investigation (CBI) has approached the Supreme Court, challenging the Delhi High Court's decision to grant bail to Kuldeep Singh Sengar, the former BJP MLA convicted of raping a minor girl in Uttar Pradesh's Unnao. The CBI's move followed the Delhi HC suspension of Sengar's life sentence and its grant of bail on December 23. While granting bail to the expelled BJP leader, the Delhi HC noted that Sengar had already served 7 years and 5 months in prison.

The Unnao rape case has been a high-profile issue, with allegations of threats being issued to the victim and her family. Sengar, after being named in the rape case, was convicted in December 2019 and sentenced to life imprisonment with a fine of Rs 25 lakh.

The CBI and the victim's family had opposed Kuldeep Singh Sengar's appeal for bail, citing safety concerns and the gravity of the crime. However, despite all the concerns, the high court granted bail.

The Delhi HC's decision to grant bail to Sengar has stirred massive outrage and protest. The court imposed several conditions, including a personal bond of Rs 15 lakh and restrictions on Sengar's movement, but the CBI has argued that these measures are insufficient to ensure the victim's safety and prevent Sengar from influencing the case.

CBI Moves To The Supreme Court

The CBI has filed a Special Leave Petition (SLP) in the Top Court, challenging the High Court's order and seeking to reinstate Sengar's life sentence. The CBI has argued that the HC failed to adopt a victim-centric approach and ignored the seriousness of the offence and the intent of the POCSO law.

Meanwhile, the Unnao rape survivor has expressed her disappointment and anger over the Delhi High Court's decision, stating that the order was a "death sentence" for her family. She has vowed to fight the case in the Apex Court, alleging that the CBI's investigation has been compromised and that Sengar has continued to threaten her and her family.
