A special NIA court in Delhi has granted default bail to US national Matthew Aaron VanDyke in a case linked to an alleged terror-conspiracy and Myanmar training-camp operation. The court granted bail on a ₹1 lakh personal bond and a surety of the same amount, directing VanDyke not to leave Delhi and to appear before investigators whenever summoned.

The core legal question: the NIA’s chargesheet against VanDyke and six Ukrainian nationals invokes provisions of the Immigration and Foreigners Act relating to alleged illegal entry, stay and movement in India. It does not, at this stage, include provisions under the Unlawful Activities (Prevention) Act, or UAPA.

The NIA has maintained that its investigation into possible UAPA offences is not closed. According to the agency, it needs more time to establish and verify the full facts relating to alleged activities, including purported assistance to ethnic armed groups and drone-training allegations. The agency says it may file a supplementary chargesheet if evidence establishes UAPA offences.

The bail order is based on legal procedure and the status of the current chargesheet; it is not a clean chit, acquittal or judicial finding that allegations against VanDyke are false. Claims describing him as a CIA operative, “deep-state agent,” mercenary or someone who “waged war on India” are not established by the court order or the NIA’s current chargesheet and should be presented, if at all, as claims requiring evidence.
