AgustaWestland Deal: Choppergate conspirator Carlo Gerosa let off

Republic TV on Thursday in an exclusive accessed the release order of AgustaWestland conspirator Carlo Gerosa. Republic TV first broke the news of Carlo's arrest on September 29.

Gerosa was apprehended by authorities in Italy on the basis of an Interpol notice activated by the ED in connection with its money laundering probe in the Rs 3,600 crore AgustaWestland VVIP choppers deal case. It is alleged that Carlo Gerosa, played the role of a middleman in the AgustaWestland deal and was involved in building a complex maze of companies to route bribes to India. Carlo Gerosa along with Guido Haschke and Christian Michel were three crucial middlemen in the VVIP chopper deal.

According to the Carlo Gerosa release order, extradition can only be allowed where expressly provided for by international conventions. The document states that absence of treaty cannot be remedied by interpretation of even in case a legal basis was identified. It adds coercive measures cannot be applied 'if there are reasons to believe that the conditions for a judgement in favour of the extradition do not exist.' Thus, as a result, Gerosa will be released unless being detained for other reasons.

ED sources confirmed the arrest of Carlo Gerosa to Republic. Top ED sources told Republic TV that they will now write to the Italian authorities and seek his extradition. ED sources add that India does not have an extradition treaty with Italy.

Earlier on September 1, the CBI filed a charge sheet in a Delhi court against former IAF Chief S P Tyagi and nine others in the AgustaWestland VVIP chopper case.
