In a setback to the Unnao rape survivor, the CBI has not charged MLA Kuldeep Singh Sengar and his associates with murder in its chargesheet, after probing into the victim's car accident in July, as per sources. Sources report that Sengar has been charged under 120-B and 506(2) of IPC which amounts to criminal intimidation and criminal conspiracy. Moreover, the driver Ashish Kumar Pal charged under 304-A, 338 and 279 IPC which amounts to causing death by negligence, grievous injurious and rash driving, according to sources. There is reportedly no mention whether the CBI will continue its probe.
Meanwhile, the victim was discharged from the All India Institute of Medical Sciences (AIIMS) hospital on September 25 after spending two months in the hospital. Reports state that the victim will continue to stay in Delhi as the family is apprehensive about returning to Uttar Pradesh. Earlier, a Delhi court had directed under the witness protection guidelines to arrange accommodation for the Unnao rape survivor and her family in Delhi. This direction came after the victim's mother requested to be allowed to live in Delhi due to threat to their lives.
The Supreme Court, on July 31, had transferred all the five cases in the Unnao accident to the CBI. It had ordered the CBI to finish the probe in the accident in seven days and seek for additional seven days time if required. It also directed the lower court in Delhi to fast-track the hearing and finish the trial within 45 days in the Unnao rape cases. It had ordered protection for rape-survivor and her family by the CRPF and also directed the U.P government to give her interim compensation of Rs 25 lakhs. Following this development, BJP finally expelled the Unnao rape accused MLA Kuldeep Singh Sengar from the party.
Earlier on 28 July, a car in which the survivor of the Unnao rape case, her family and lawyer were traveling was hit by an over-speeding truck in Rae Bareli on Sunday, killing victim's two aunts while leaving her and her advocate critically injured, police said. The family was allegedly visiting the Unnao rape victim's uncle, who is currently in Raebareli jail. The police are currently investigating the circumstance under which the accident has occurred. Sources also report that a truck had allegedly hit the victim's car and the truck.
