New Delhi: A day after Delhi High Court Judge Justice Yashwant Varma came under scrutiny following the recovery of unaccounted cash from his residence in Delhi, a video has surfaced showing piles of burned cash at his house. The stunning footage, accessed from inside Justice Yashwant Varma’s residence, is reportedly from the night of the fire incident which took place on March 14 (during the Holi weekend) and depicts officers wading through large stashes of cash. The video emerged after the Supreme Court of India released Delhi High Court Chief Justice Devendra Kumar Upadhyaya's report on the Delhi judge cash recovery case involving Justice Yashwant Varma. The 25-page report including documents, photos has been made public on SC's website.
The video, seems to establish conclusively that the sitting High Court judge’s home did have large stashes of hard cash. The video flies in the face of the desperate clumsy narrative being made - one that has witnessed wishy washy versions after versions from the fire department on the aspect of the presence of large amount of hard cash being unearthed from the home of the Judge.
The video also raises serious questions on the decision of the Supreme Court collegium to have transferred the judge instead of taking a firmer view. The Collegium, after the incident had come to light, had transferred the judge in question to his parent Allahabad High Court, which in fact objected to this saying that they were not a trash bin.
The video also raises questions of where these cash actually came from, is it a favour? These are questions that will lead to doubt on several judgements that Justice Yashwant Varma presided upon. This also raises questions on why there was silence on this so far. The report of the Delhi High Court Chief Justice Devendra Kumar Upadhayaya, released by the Supreme Court of India on Saturday night, contains many documents, photos in its 25-page stack. The document shows two photos from the residence of Justice Varma showing how sacks of burned down cash.
Meanwhile, questions will also be raised on the highest courts of the country on the handling of the case. Media pressure was crucial in this case and the visuals on the Republic Media Network also raised questions on the handling of the entire incident.
Questions also arise, on who paid the money that was being burnt at Justice Yashwant Varma's home. Like top jurist Harish Salve told Republic, the "Caesar's wife should be above suspicion" and it is up to India's Supreme Court to come clean with all the facts. The facts should not just be put out but justice should also be seen to be done.
What you are seeing today in this video is not just a sack of cash being burnt at any one's house but one of India's top most judges. The Supreme Court has so far not sacked Justice Yashwant Varma but only transferred him. The top court has so far not acted in a way that the nation would be watching in admiration.
The Republic Media Network has not underplayed the matter and will continue to hold the mirror to the other three estates of this country.
The Supreme Court released the inquiry report filed by Delhi High Court Chief Justice Devendra Kumar Upadhyaya into the controversy relating to High Court Justice Yashwant Varma. In his report, the Delhi High Court Chief Justice said that he is of the prima facie opinion that the entire matter warrants a deeper probe.
Supreme Court also released the response of Justice Yashwant Varma, who has denied the allegations and said that it clearly appeared to be a conspiracy to frame and malign him. No cash was ever placed in that storeroom either by him or any of his family members, and he said he strongly denounced the suggestion that the alleged cash belonged to them. The room which caught fire and where cash was allegedly found was an outhouse and not the main building where the judge and family reside.
On Saturday, Chief Justice of India Sanjiv Khanna constituted a three-member committee to investigate the allegations against Justice Yashwant Varma.
The committee comprises Justice Sheel Nagu, Chief Justice of the Punjab & Haryana High Court; Justice GS Sandhawalia, Chief Justice of the Himachal Pradesh High Court and Justice Anu Sivaraman, Judge of the Karnataka High Court.
The CJI asked Delhi High Court Chief Justice not to assign any further judicial work to Justice Yashwant Varma.
Delhi High Court Judge Justice Yashwant Varma had come under scanner after massive unaccounted cash was allegedly recovered from his residence when a fire broke out at his residence on March 14.
According to reports, Justice Yashwant Varma and neither his wife were present at his residence when the fire broke out as they were in Bhopal. The fire department received a call from someone at his house after which firefighters reached his home and doused the flames.
Later when Republic Media Network accessed the Delhi fire department report, the documents didn't mention that any cash was recovered from the fire site, which raised suspicion that the department was trying to cover up.
Legal eagles and members of the judicial fraternity have also questioned the collegium's action in this case so far. They have been of the opinion that mere a transfer was not enough, adding the Justice Yashwant Varma should have been asked to resign or impeached.
